Terms of Service

2. Definitions

• Account: Your user account on Lollipop Links.
• User Content: Any content you publish or upload (links, text, media).
• Fee / Network Fee: Charges that may apply for publishing or interacting (e.g., 0.002-0.005 SOL about $0.25 cents).
• Third-Party Services: External platforms we integrate (wallets, marketplaces, analytics, payments).

3. Eligibility & Accounts

• You must be at least 13 years old.
• You represent that you have the authority to use any wallet or account you connect.
• You are responsible for your Account security and all activity under it.
• Notify us promptly if you suspect unauthorized access or compromise.

4. Wallets & On-Chain Activity

• Connecting a wallet enables verification and control of your identity/items within Lollipop.
• On-chain actions (publishing, linking, claims) are public and irreversible.
• You are responsible for fees, gas, failed or replayed transactions, and wallet security.
• We are not liable for lost keys, wallet hacks, or unauthorized on-chain activity.

5. Publishing & Fees

• Publishing (e.g., your Lollipop link) may require a network fee (currently 0.002 SOL).
• We may change fees with notice; new fees apply prospectively.
• Publishing may be final; on-chain data cannot be deleted by us.
• We may apply rate limits or remove content that violates these Terms.

6. Physical Products & NFC Items

• Purchases are processed via Shopify (and governed by Shopify’s terms/policies).
• NFC items link to your profile; you are responsible for activation, custody, and transfer.
• All sales are final unless otherwise stated on the product page.
• Ownership verification or linking may rely on blockchain records.

7. Acceptable Use

You agree not to:

• Upload illegal, infringing, defamatory, obscene, or harmful content.
• Impersonate others or misrepresent affiliations.
• Interfere with, disrupt, or abuse the Services or networks.
• Reverse-engineer or circumvent security features.
• Use the Services to facilitate unlawful activity.

We may remove content, suspend accounts, or limit access for violations.

8. Intellectual Property

• All platform software, design, and branding are owned by I Build Cool Shit LLC.
• You retain ownership of User Content you post.
• By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and transmit your User Content as necessary to operate and promote the Services.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted, secure, or error-free operation, nor immunity from blockchain/network risks.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, I BUILD COOL SHIT LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; OR FOR LOSS OF PROFITS, REVENUE, DATA, OR TOKENS; ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE USD/SOL EQUIVALENT OF FEES YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Lollipop and its personnel from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services or your User Content.

12. Termination

• We may suspend or terminate access at any time, with or without cause.
• You may close your Account via settings or by request.
• Upon termination, access ceases and off-chain data may be deleted or archived. On-chain records remain.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Colorado, unless we mutually agree to arbitration.

Claims must be brought within two (2) years after the cause of action accrues, unless a shorter period is required by law.

14. Changes

We may update these Terms from time to time. We will update the “Last Updated” date and may provide additional notice for material changes. Continued use indicates acceptance of the updated Terms.

15. Miscellaneous

• Severability: If any provision is invalid, the remaining provisions remain in effect.
• Waiver: Failure to enforce a provision is not a waiver of future enforcement.
• Assignment: You may not assign these Terms without our prior written consent.
• Notices: We may notify you via email, in-app messages, or site banners.
